The project aims to delegate to the private sector the tasks related to project design, installation, operation, management and maintenance of the communications, control and management infrastructure of the Communication Networks of the Brazilian Air Force Command - COMAER. It is the first public-private partnership of the Federal Government's Direct Administration and involves the establishment of an “Administrative Concession” type of partnership, as provided for in Law No. 11.079 / 2004.
The proposal establishes the hiring of a Special-Purpose Entity (SPE) that provides the Integrated Network Management service nationwide, with remuneration based on its performance. The contract includes responsibilities for designing, installing, updating, expanding, operating, managing and maintaining a communications, control and management infrastructure for COMAER for 25 years. It follows the model of similar international projects, such as the European Organisation for the Safety of Air Navigation (Eurocontrol) and the US Federal Aviation Administration (FAA).
This partnership will replace 68 (sixty-eight) administrative contracts currently in force and involves a maximum annual consideration of the Federal Government worth of BRL 210.83 million (June 2019 prices) to be paid through airfares, namely: the Charge for the use of Communications and Aids to Enroute Air Navigation (TAN) and the Charges for the use of Communication and Radio Aids to Air Navigation at Approach Control Areas (TAT APP).
According to the feasibility studies, these tariffs represented about 8% of the resources destined to the Brazilian Airspace Control System, which is responsible for controlling an area of 22 million km2 (it encompasses the Brazilian airspace – territorial waters included –, the exclusive economic zone and a wide area of international waters in the Atlantic Ocean).
The feasibility studies were completed in 2017 and the project was sent to the Federal Court of Accounts, which approved the initiative on 08/08/2018 through Judgment 1.843 / 18. The 1st bid and guarantee delivery session was held at Bovespa (B3) on 6/26/2019. At the time, there were no interested parties. The next session is scheduled for September 2020, depending on conditions caused by the COVID-19 pandemic.
The value of the contract over 25 years, at June 2019 prices, is BRL 5.27 billion, investment is around BRL 1.54 billion and operating costs total BRL 2.24 billion.
